In the Argentine Civil Code repealed in 2015, unlawfulness was formal and subjective, since it was required that the harmful act was 'expressly prohibited by a rule' and that the agents acted with 'intent, fault or negligence'. Now all this has changed, the new unified Civil and Commercial Code of the Argentine Nation established an 'objective and material' type of unlawfulness.
